Regulatory Challenges in Governing Digital Platform and E-Commerce in India

ABSTRACT
In this digital world buying and selling of products and services are shifting towards digital platform this makes a modern era regulatory challenge, and the issues faced in posting content on the internet. When we create content and post in digital platforms the content may be pirated through internet intermediary and may infringe Intellectual property rights of individual and by using AI deep fake videos of individual are posted on internet without their consent. Product liability issues in e-commerce for returning product which are defective or is not of adequate standards or the breach of warranty that are dealt in the E-Commerce platforms their liability on manufacture or buyers in consumer protection act, sales and goods act, and tort law. The privacy issues encountered by individual through some digital platforms that are not reliable and Internet of Things which collects the sensitive data of individual that leads to data privacy and supply it to the third party without consent. This also leads to cybercrime or the breach of cyber security where hackers use this information to access bank accounts of individual which leads to financial losses. The regulations of advertisements that are surrogate or misleading for the product or services and are covered under Information and technology act and the self-regulatory organization called the (ASCI). To counter the issues and resolve the dispute online dispute resolution (ODR) can be used for providing remedies to the parties or other dispute resolution method can be used in this digital world. These are the regulatory challenges which are faced in the Digital platform and E-commerce in India and are explained under the Article.
