A Legal Perspective of Cybersecurity Compliance in The Age of Data Sovereignty

ABSTRACT

As the use of information technology and enterprise systems continue to grow, it is necessary for species-compliant to conduct with standards for ensuring the security of triple data against cyber threats. In addition, the growth of the sovereignty of data and some states’ attempts to gain control over data processed within their territory have also influenced the legal framework of cybersecurity. In this paper, cybersecurity compliance and data sovereignty are analyzed in order to establish the current status of laws and regulations related to cross-border data transfer and security. This paper is intriguing to the legal fraternity, entrepreneurs, and policy makers since data sovereignty is emerging as a vital consideration in international commerce as well as the digital economy. Despite all the study done on cybersecurity laws and data protection, there is little literature on how data sovereignty complicates compliance programs. Recognizing this tension, the study question of this study is to understand how existing legal and regulatory structures resolve this tension in the context of MNOs. The enforcement mechanisms and implications are understood by the use of a comparative legal study that review cybersecurity laws across jurisdictions, case studies and legal texts. Highlights point that data sovereignty improves national security, yet it regularly clashes with globally accepted cyber security standards, which makes compliance a difficult task. The paper will him to the legal field because it will seek to explain how the concept of data sovereignty can be aligned with cybersecurity policies of other  nations with a view of providing recommendations for businesses that seek to practice it across borders.
